The communication alleged that the Party concerned, by failing to provide for public participation in the decision-making process for construction permits of the Power Plant, failed to comply with article 6 (1), (4) and (10) of the Convention. The communicant also alleged that the Party concerned failed to comply with article 9 (2) (3) and (4) of the Convention, due to an alleged lack of access to justice in environmental matters in legislation.
